The security deposit is the single largest sum most tenants hand over, and the one most often disputed at the end of a tenancy.
What the Deposit Is Actually For
A deposit covers unpaid rent and damage beyond normal wear and tear. It is not an advance on rent, and it is refundable in full if the property is returned in the condition you received it.
What a Landlord Can Legally Deduct
- Unpaid rent or utility bills
- Repairs for damage you caused
- Cleaning, if the property is left unreasonably dirty
Normal fading, minor scuffs and ordinary wear are not deductible.
How to Protect Your Refund
- Document the property's condition in writing on day one
- Keep every rent receipt and payment record
- Give proper notice in writing
- Do a joint final inspection with the owner present
